TERMS AND CONDITIONS OF PURCHASE

Application and borrower

The General Terms and Conditions are applicable to sales contracts entered into electronically, through the website www.olivaoliva.com, between Oliva Oliva Internet S.L. and consumers and users who wish to purchase the products displayed therein.

Completion of the contract

In accordance with the provisions of the Civil Code, the contract will be understood to be perfected from the moment Oliva Oliva Internet S.L. is aware of the acceptance of the offer by the customer.

Language

The proposed language for the conclusion of the contract is Spanish.

Acceptance of the General Conditions of Purchase

Before concluding the contract, the customer must read the General Terms and Conditions of Purchase and accept them by ticking the corresponding box during the ordering process.

Storage / Data Protection

The personal data you provide us with, as well as those generated during the use of our services, will be included in a file under the responsibility of Oliva Oliva Internet S.L. in order to provide you with the information requested, manage the products or services contracted, and keep you informed about products, provided that you have given your prior consent to this effect, services or news, related to the information security sector, which may be of interest to you. You authorise Oliva Oliva Internet S.L. to receive confirmation of receipt and reading of the communications sent to you by email.

In any case, you are guaranteed the possibility of exercising your rights of access, rectification, cancellation and opposition to the processing of your data, by sending a written communication to the address indicated or to the e-mail address info@olivaoliva.com

Prices

The prices of our products contain the applicable VAT according to current legislation. The prices mentioned on our website, including other items, are initially quoted in Euros, with the possibility of changing the currency to pounds sterling or US dollars. Shipping costs have not been included in the prices shown on our website. Any other additional costs that may arise shall be borne by the purchaser, who shall be informed of all amounts and the resulting final price before the conclusion of the contract.

Deliveries to destinations outside the European Union may incur additional costs and may be subject to taxes and duties, in particular customs and value added taxes on importation. All costs incurred by the destination outside the European Union shall be borne by the purchaser.

Delivery

Shipping costs are invoiced according to the prices indicated on the website. The exact amount of the shipping costs is indicated in the order process.

The delivery of the article will be made to the address indicated by the customer at the time of purchase.  The dispatch of the order will be from the day following receipt and conformity of payment, excluding weekends and public holidays. The delivery time in Spain is 1 to 3 working days, except in the Canary Islands, Ceuta and Melilla, which may be delayed due to customs issues. In most European Union countries the delivery time is 3 to 6 working days. For the rest of the world, the delivery time is 4 to 10 days, depending on the country of destination.

The customer must check that the goods received after purchase correspond to those ordered*. If you are not satisfied with your purchase, you can contact us at info@olivaoliva.com stating clearly what the problem is. We will contact you as soon as possible to find a satisfactory solution.

*It is advisable to open the packaging in the presence of the carrier, in case any product has been damaged or is in poor condition.

- If any product arrives damaged due to transport, we will send you a new one or we will refund the corresponding amount to the credit card account with which you made the payment. In any case, you will have to send us pictures of the damaged product to info@olivaoliva.com. Oliva Oliva Internet S.L. will be responsible for the transport costs, taking into account the reasons given above.

- If any of the products do not correspond to your purchase made through our website, we will send you the correct products or we will refund the corresponding amount to the credit card account with which you made the payment. Oliva Oliva Internet S.L. will be responsible for any extra transport costs that may arise.

Online payments

We offer you the following payment methods to make your purchases on our website:

Please note that the goods will only be dispatched once the total amount of the order has been received. Under no circumstances will orders that have not been paid in full be dispatched. If you choose to pay by bank transfer, it is advisable to make the payment as soon as possible, as delivery times may be delayed by several days depending on the bank, and the dispatch of your order may be affected.

Order cancellations

The customer may cancel their order at Oliva Oliva Internet S.L. by writing to our address info@olivaoliva.com within 12 hours of placing the order, provided that the order has not already been dispatched to its destination.

Information on the right of withdrawal

You have the right to withdraw from this contract within 30 calendar days without giving any reason. The withdrawal period will expire 30 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired the material possession of the last of these goods.

To exercise the right of withdrawal, you must request us at Oliva Oliva Internet S.L., address Pechuán, 12 (28002, Madrid), telephone +34 910 71 60 16 and e-mail info@olivaoliva.com, your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or e-mail). You may use the model withdrawal form below, but its use is not compulsory.

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

Consequences of withdrawal

In the event of withdrawal by you, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of delivery ordinarily offered by us) without undue delay and, in any event, no later than 30 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any costs as a result of the refund.

We may cancel the refund until we have received the goods back, or until you have provided proof of return of the goods, whichever condition is met first.

You must return or deliver the goods directly to us at the premises of Oliva Oliva, located at Calle Pechuán, 12 (28002, Madrid), telephone +34 910 71 60 16 and email info@olivaoliva.com without undue delay and, in any event, no later than 30 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if the goods are returned before this period has expired.

You shall bear the direct cost of returning the goods. You alone shall be liable for any diminished value of the goods resulting from improper handling or handling other than that necessary to establish the nature, characteristics and functioning of the goods.

Regulatory basis

Art. 103 of Law 3/2014, of 27 March, General Law for the Defence of Consumers and Users (LGDCU) states the following:

The right of withdrawal shall not apply to contracts relating to:

a) The provision of services, once the service has been fully performed, where performance has begun, with the prior express consent of the consumer and user and with the acknowledgement by him that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.

b) The supply of goods or services the price of which depends on fluctuations in the financial market which are beyond the trader's control and which may occur during the withdrawal period.

c) The supply of goods made to the specifications of the consumer and user or clearly personalised.

d) The supply of goods that are likely to deteriorate or expire quickly.

e) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

f) The supply of goods which after delivery and taking into account their nature have become inseparably mixed with other goods.

g) The supply of alcoholic beverages whose price has been agreed at the time of concluding the sales contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond the entrepreneur's control.

h) Contracts where the consumer and user has specifically requested the trader to visit him for urgent repairs or maintenance; if, during such a visit, the trader provides services in addition to those specifically requested by the consumer or supplies goods other than spare parts necessarily used to carry out the maintenance or repair, the right of withdrawal should apply to those additional services or goods.

i) The supply of sealed audio or video recordings or sealed software which have been unsealed by the consumer and user after delivery.

j) The supply of newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.

k) contracts concluded by means of public auctions

l) The supply of accommodation services for purposes other than the provision of housing, transport of goods, car rental, catering or services related to leisure activities, if the contracts provide for a specific date or period of performance.

m) The supply of digital content which is not provided on a tangible medium where performance has begun with the prior express consent of the consumer and user with the knowledge that he/she loses his/her right of withdrawal as a result.

Complaint forms are also available at our point of sale located at Calle Pechuán 12, 28002 Madrid, Spain. They can be requested in person from Monday to Thursday from 9:00 to 18:00h. and Friday from 9:00 to 15:00h.

Legal Guarantee

We inform about the existence of the legal guarantee for the products offered for sale at Oliva Oliva Internet S.L. according to the provisions of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November. To exercise the right of guarantee, it is essential to present the sales document.
